CE Marking for Machinery Imported Into Europe: A Buyer's Checklist

CE marking is a legal requirement, not a sticker

If you import machinery into the European Economic Area, CE marking is mandatory. It is the manufacturer's declaration that the machine meets EU health, safety and environmental requirements (for most machinery, the Machinery Directive, now moving to the Machinery Regulation). Treat a missing or fake CE mark as a serious risk: customs can stop the goods, and you can be liable.

Who is responsible?

This surprises many first-time importers: when you import from outside the EU, you can be treated as the one placing the product on the EU market, which means responsibility can fall on you. So you cannot simply trust a logo. You need the supporting paperwork.

What to ask your supplier for

Before you order machinery destined for Europe, request and check:

• EU Declaration of Conformity (DoC): a signed document naming the machine, the directives/regulations it meets, and the standards applied. This is the key document.
• Technical file availability: the manufacturer must hold a technical construction file. You may need access to it.
• Test reports: supporting reports from the relevant harmonized standards.
• The CE mark itself: correctly applied to the machine and, where required, an identification plate with manufacturer details.

Red flags

• A CE logo on the website but no Declaration of Conformity on request.
• A "CE" mark with letters spaced differently (the lookalike "China Export" myth is not a legal basis, but oddly formed marks are a prompt to check the paperwork).
• A supplier who cannot name which directive or standard applies.

Practical steps for buyers

1. Confirm CE applies to your specific machine and market.
2. Get the Declaration of Conformity in writing before you pay the balance.
3. Keep the documents on file; customs or authorities can ask for them.
4. If the value or risk is high, have a third party review the conformity documentation.

The bottom line

CE marking protects you and your customers, but only if the paperwork is real. Make the Declaration of Conformity a condition of the order, not an afterthought.
